Terms and conditions

ARTICLE 1 - Scope of application

These General Conditions of Sale (known as “CGV”) apply, without restriction or reservation to all sales concluded by the Seller to non-professional buyers (“Customers or the Customer”), wishing to acquire the products offered for sale (“The Products or The Product”) by “the Seller” on the enjoytheclock.com website.

These General Terms and Conditions are accessible at any time on the enjoytheclock.com website and will take precedence over any other document.

Placing an order constitutes prior, immediate and unreserved acceptance of the General Terms and Conditions by the Customer.

The Seller reserves the right to modify these General Terms and Conditions at any time without notifying its Customers, by publishing a new version on the Site.

The version applicable to the Customer's purchase is that in force on the Site on the date the order is placed. Modifications to these General Terms and Conditions cannot apply to transactions concluded prior to their posting online.

The main characteristics of the Products and in particular the specifications, illustrations and indications of the Products, are presented on the site enjoytheclock.com, which the customer is required to read before ordering.

The choice and purchase of a Product are the sole responsibility of the Customer.

Due to the diversity of materials likely to be used by the Customer for displaying the Site and possible variations in colorimetric and qualitative reproduction of Product photographs, the photographs do not fall within the contractual scope.

ARTICLE 2 - Price

The Products are supplied at the current prices appearing on the enjoytheclock.com website, when the order is registered by the Seller.

Prices are expressed in euros including tax.

The prices take into account any reductions that may be granted by the Seller on the enjoytheclock.com website.

In certain cases, to benefit from a promotional rate, the Customer must indicate their advantage code in the dedicated location on the Site.

The prices do not include delivery costs which are invoiced in addition, under the conditions indicated on the site and calculated before placing the order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

In the event of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and Overseas Territories, the price will be calculated excluding taxes automatically on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility and are the sole responsibility of the Customer.

An order confirmation will be established by the Seller and sent to the Customer by email.

ARTICLE 3 – Orders

It is up to the Customer to select the Products he wishes to order on the enjoytheclock.com website, according to the following terms:

The Customer chooses a Product which he places in his basket, a Product which he can delete or modify before validating his order and accepting these General Terms and Conditions. He will then enter his contact details and choose the delivery method. After validation of the information, the order will be considered final and will require payment from the Customer according to the terms provided.

Product offers are valid as long as they are visible on the site, while stocks last. In the event of an order for a Product that becomes unavailable, the Customer will be informed of this unavailability, as soon as possible, by email. The customer can then opt for a refund or replacement with another product of equivalent price.

The sale will only be considered valid and final after full payment of the price.

Any order placed on the enjoytheclock.com website constitutes the formation of a contract concluded remotely between the Customer and the Seller.

The Seller reserves:

- the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or an objective suspicion of fraud.

- to block the Customer's order in certain cases, in particular in the event of an incorrect address or other problem on the Customer's account, until the problem is resolved. The cancellation of the order for this Product and its possible reimbursement will then be carried out under the conditions and terms of these General Terms and Conditions.

ARTICLE 4 - Payment conditions

Payment for orders is made by credit card or Paypal.

The price is payable in cash by the Customer, in full on the day the order is placed.

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider involved in banking transactions carried out on the enjoytheclock.com site.

Payments made by the Customer will only be considered final after effective collection by the Seller of the sums due.

The Seller will not be required to deliver the Products ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above.

In the event of an order to a country other than mainland France, the Customer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be eligible. These rights and sums do not fall within the responsibility of the Seller. They will be the responsibility of the Customer and are their entire responsibility, both in terms of declarations and payments to the competent authorities and organizations in the country. The Seller advises the Customer to inquire about these aspects with the local authorities. The Seller cannot be held responsible for non-payment of these taxes.

ARTICLE 5 - Deliveries

Delivery times mentioned when ordering are given for information purposes only. Delays compared to the announced deadline cannot give rise to order cancellation or claims for damages from the Customer.

The Seller cannot be held responsible for any delay in delivery not being its fault or justified by a case of force majeure.

The Customer is required to check the condition and completeness of the products delivered. He has a period of 5 days from delivery to submit complaints by email to contact@enjoytheclock.com, accompanied by all relevant supporting documents (photos in particular). After this period and failing to have complied with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by the Seller.

The Seller will replace or reimburse if the product is no longer available as soon as possible and at its expense, the Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in articles L 217-4 et seq. of the Consumer Code.

Checking the condition of the package upon delivery is the responsibility of the Customer. Any damage must be reported to the carrier.

ARTICLE 6 - Transfer of ownership

The transfer of ownership of the Products from the Seller to the Customer will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said Products.

ARTICLE 7 - Right of withdrawal

In accordance with current legislation, the Customer has a period of 14 (fourteen) working days from receipt of the Product to withdraw and a period of 14 days from withdrawal to return the package. The right of withdrawal can be exercised by email to contact@enjoytheclock.com.

The Products must be returned complete and undamaged in their original condition and packaging allowing them to be re-marketed in new condition, accompanied by the Customer's name, first name and postal address and the order number. Damaged, soiled or incomplete Products will not be returned. Return costs remaining the responsibility of the Customer. The return is made under the full responsibility of the Customer and any risk linked to the return of the goods (breakage, theft, etc.) will be the responsibility of the Customer.

The exchange (subject to availability) or refund will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions provided for in this article.

ARTICLE 8 - Personal data

The Customer is informed that the collection of his personal data is necessary for the sale of the Products, their delivery and their warranty. These personal data are collected solely for the execution of the sales contract.

The personal data collected on the enjoytheclock.com site are as follows:

When ordering Products by the Customer: Names, first names, postal address and e-mail address.

When activating the guarantee: Names, first names and email address.

Personal data is under no circumstances transmitted to third parties.

Personal data is reserved for the sole use of the Seller.

The data controller is the Seller, within the meaning of the Data Protection Act and as of May 25, 2018, Regulation 2016/679 on the protection of personal data.

The Seller will keep the data thus collected for a maximum period of 5 years, covering the period of limitation of the applicable contractual civil liability.

In application of the regulations applicable to personal data, Customers of the enjoytheclock.com site have the following rights:

  • Know the personal data concerning them
  • Request updated information information
  • Request deletion of their personal data, in accordance with applicable data protection laws

These rights, as long as they do not oppose the purpose of the processing, can be exercised by sending a request by email to contact@enjoytheclock.com.

ARTICLE 9 - Intellectual property

The content of the enjoytheclock.com site is the property of the Seller and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.

ARTICLE 10 - Applicable law - Language

These General Terms and Conditions and the operations resulting from them are governed and subject to French law.

These General Terms and Conditions are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.

ARTICLE 11 - Disputes

All disputes relating to purchase and sale transactions concluded in application of these General Terms and Conditions and which have not been the subject of an amicable settlement between the Seller, will be submitted to the competent courts under the conditions of common law.
